Class Action

From the very beginning of the legislative process relating to the Act of 17 December 2009 on the Pursuit of Claims in Group Proceedings, we have been actively involved in introducing the possibility of filing class actions into the Polish legal system, following the example of the American class action.

KKG was also one of the few law firms in Poland to undertake class actions immediately after the Act came into force. The first lawsuit against, among others, the State Treasury, brought by KKG, successfully passed the initial phase of the proceedings, i.e. the certification, becoming one of the first cases in Poland.

KKG partners prepared a legal opinion on the draft law on behalf of the Office of Analysis of the Chancellery of the Sejm of the Republic of Poland. They also participated as experts in the meetings of the Sejm’s Committee on Justice and Human Rights, and cooperated as experts in the economic law team of the Minister of Development, dealing, among others, with changes in group proceedings in Poland.

Sandomierz group proceedings

The action is connected to public authorities’ negligence and omissions in the area of carrying out the duties in the scope of flood protection which in May 2010 resulted in the breaking of the right bank levee on the Vistula River in the Koćmierzów district of the city of Sandomierz and, subsequently, in the flooding of the right bank area of Sandomierz and the adjacent area.

Płock group proceedings

The action is connected to the public authority’s omissions in the scope of flood protection which resulted in the breaking of a levee in the village of Świniary in the commune of Słubice in May 2010 and, consequently, two waves of flooding of the adjacent area of Dolina Iłowsko-Dobrzykowska.

ZUS group proceedings

The proceedings were connected with the issue of submitting notifications on breaks in the conducting of business activity to the Social Insurance Institution [ZUS] by entrepreneurs – natural persons before the introduction of the possibility of the formal suspension of business activity, meaning before the date of 20 September 2008.
