Rafał Kos, PhD, and Maciej Durbas, PhD, co-wrote the Commentary to the new Rules of the Court of Arbitration at the Confederation of Leviathan (CACL) - one of the most important publications in the field of institutional arbitration.
The publication, edited by Associate Prof. Marcin Aslanowicz, PhD, and published by Wolters Kluwer Polska, provides a detailed discussion of the provisions governing proceedings before the CACL, taking into account current case law and literature from both domestic and foreign sources.
The study takes into account the body of work developed under the UNCITRAL Model Law, as well as the arbitration rules of UNCITRAL, ICC, SAKIG, DIS, and SCC. All considerations are referred to the relevant provisions of Part Five of the Code of Civil Procedure. The publication also takes into account the jurisprudence of the CACL and the rulings of the CACL Nominating Committee on motions to exclude an arbitrator.
The commentary was written for practitioners, including attorneys, arbitrators, judges, and entrepreneurs involved in arbitration proceedings.
