What are the causes of
disputes over WIBOR? What is the current line of jurisprudence of Polish and EU
courts? What allegations do borrowers make? What can be expected from the
CJEU's ruling in Case C-471/24?
Wojciech Wandzel, partner at
KKG Legal, and Aleksandra Kuzawińska, senior counsel at KKG Legal, answered
these and many other questions during an online training course organized by
Wolters Kluwer on July 8, 2025.
Nearly 2,000 proceedings are
currently pending in Polish courts regarding the use of the WIBOR index in loan
agreements. The first (also non-final) verdicts are appearing in the public
space, raising interest on both sides of the argument. Additionally, there are
preliminary questions before the CJEU that could significantly impact the
further direction of these disputes.
The training was particularly
valuable for employees of financial institutions, trial attorneys, judges, and
trainees dealing with WIBOR-based loans and consumer protection in the
financial services market.
