On Thursday, April 13, during the 15th Construction Law Congress organized by Must Read Media Publishing House, Ewa Przyśliwska-Urbanek, attorney-at-law, a senior associate at KKG Legal, gave a presentation titled “Energy Storage Facilities in Light of the Amendment to the Construction Law.”
There is growing talk in the industry that 2026 could be the “year of energy storage.” This trend is driven, among other things, by a significant amendment to the Construction Law—a regulation that, on the one hand, opens up new investment opportunities and, on the other, introduces specific obligations and risks.
During the presentation, the following topics were discussed in particular:
▪️ the new definition of energy storage in the regulations,
▪️ formal requirements for obtaining a building permit and cases where this requirement is waived,
▪️ fire safety issues,
▪️ practical implications of the changes taking effect in 2026
The Congress program also included topics such as the latest changes in construction law, contractual penalties in construction contracts, and the protection of subcontractors in light of the amendment to the Civil Code and current case law.
