Barbara Jelonek-Jarco, PhD, co-managing partner at KKG, spoke at the "Drafting Effective International Contracts – How to Tailor Liability and Ringfence Risks in International Sales and Distribution Contracts" seminar in Prague on April 18-19.
Together with Benjamin Strauss and Ulrich Muenzer, she shared insights on the impact of applicable law and jurisdiction on damages with a particular focus on the recognition of foreign decisions and limitations regarding punitive damages.
Legal experts, academics, practitioners, and in-house counsels shared their experiences and exchanged views on possible strategies to limit liability through contractual clauses on one side and, on the other, once a contract had been breached, to effectively claim damages.
