The 4th Claims Management in Construction Conference, organised by Must Read Media Publishing, was held last Thursday.

The event was a great opportunity for construction claims practitioners to expand their knowledge and benefit from the experience of industry experts. Topics discussed include:

  • contractual penalty claims in practice and case law,
  • legal tools for settling debts towards subcontractors and suppliers (e.g., assignment, transfer, assumption of debt, joint and several liability, direct payment),
  • indirect cost issues in construction contracts.

During her presentation, Aleksandra Kuzawinska, senior counsel at KKG, discussed key issues related to lump sum remuneration and additional works in construction contracts. She outlined who bears the risk of incorrectly determining the amount of the lump sum remuneration, explained what additional works are and on what legal grounds a contractor can claim remuneration for their implementation, and discussed the standard of proof that is incumbent on a contractor claiming remuneration for additional works performed.
