On 3 December, a training course entitled “Group Proceedings in Poland - An Outline of the Institution and its Place in the Legal System, a New Opening?”, was held and was conducted by Agnieszka Trzaska-Smieszek, KKG partner.
The training was a compendium of knowledge about group proceedings in Poland. The following topics were discussed:
• Objectives and general characteristics of group proceedings as a mechanism for collective redress.
• The latest legislative changes in the Act on Pursuing Claims in Group Proceedings - that is, a new subtype of group proceedings in consumer cases concerning the violation of general consumer interests.
• The prerequisites for the admissibility of group proceedings and the particular legal standing shaped therein.
• Phases of group proceedings.
• Past practice of proceedings in Poland with thoughts on what could be changed.
The training ended with a question-and-answer session, which provided an opportunity for valuable substantive discussions.
It was organised by the Section of Dispute Practitioners at the Krakow Bar Association.
