On 7 September 2020, the group proceedings initiated by the statement of claims brought forth by Zbigniew Rusak representing a group of persons affected by the flood (the damages amount to around PLN 17 million) in May 2010 from Sandomierz and the surrounding areas were concluded in a final manner. Kubas Kos Gałkowski represented the claimant in this case.
In the judgment of 7 September, the Court of Appeals in Krakow dismissed the appeal of the State Treasury and the Świętokrzyskie Voivodeship against the judgment of the District Court in Krakow of 19 October 2017.
On the basis of a final judgment establishing the liability for damages, group members will be able to pursue the payment of a specific amount of damages form the Defendants. The courts hearing these individual claims will only determine the amount of damages suffered by a specific group member, being bound by the establishments from the judgment issued in the group proceedings that the source of the damages was negligence on the part of the Defendants and the State Treasury and the Świętokrzyskie Voivodeship are liable for the damages.
