On 28 October, the 2nd Congress of Contract Terms in the Construction Industry was held. Marek Topór, PhD, a senior associate at KKG, delivered a lecture entitled Current Problems in the Practical Application of Contract Terms in the Construction Industry.
During his presentation, he addressed, among others, such issues as:
- Functions of a contractual penalty in construction works contracts. The problem of the repressive nature of a contractual penalty.
- The legal problem of stipulating a contractual penalty without specifying its maximum amount.
- The compensatory nature of damages and the problem of mitigating contractual penalties.
- Guidelines for including contractual penalties in construction works contracts.
