On 26 April, a webinar titled “Competence of the Ruling Bench – Practical Issues” was held by the SAKIG Youth Arbitration Forum. During the webinar, Maciej Durbas, PhD, of counsel at Kubas Kos Gałkowski, presented issues concerning, among others, a plea of lack of competence, including its preclusion, a possibility of adjudicating ex officio by the ruling bench and the scope of control over the competence of an arbitration court at different stages of the case.
The webinar addressed practical issues related to challenging the ruling bench’s competence by the parties and the adjudication on the competence of the ruling bench – both by the bench itself and by the common courts.
