Julita Zawadzka, PhD, prepared the opinion of the Polish Bar Council as part of the Ministry of Development and Technology’s review of the operation of the Family Foundation Act - a regulation that has become, in recent years, one of the key instruments for succession planning in Poland.
In connection with the ongoing work, Julita Zawadzka will also represent the Polish Bar Council in consultation meetings organized by the Ministry of Development and Technology, which will take place on March 4-5, 2026. The consultations will cover a wide range of issues related to the functioning of family foundations - from business activity and taxation to entitlement to a forced share, as well as the register of family foundations, auditing, and accounting.
The meetings will also be attended by representatives of the Ministry of Finance, the Ministry of Justice and the Ministry of Agriculture and Rural Development, which underscores the inter-ministerial nature of the work in progress and the importance of the issues under discussion for the practice of business.
Participation in the opinion process and legislative consultations is an important part of the debate on the further shape of regulations on family foundations - an institution that plays an increasingly important role in managing assets and building multi-generational business continuity.
