‘Contesting an Act in Law Performed by a Debtor With Detriment to Creditors’ Scientific Conference

On 30 November, Warsaw hosted a scientific conference ‘Contesting an Act in Law Performed by a Debtor With Detriment to Creditors’ organised by Lazarski University Institute for Bankruptcy and Restructuring Law and Bankruptcy Research and Adam Mickiewicz University in Poznan.

The proceedings of the event included an analysis of the legal nature of Actio Pauliana as well as the objective scope of invalidity of debtor’s acts in law in bankruptcy and restructuring proceedings.

The event was accompanied by a poster session with Grzegorz Pobożniak, attorney-at-law and partner at Kubas Kos Gałkowski as well as Tomasz Sowa, associate at Kubas Kos Gałkowski, as speakers. The legal issue that provided the subject for the discussion was the question of the mode and priority of satisfying a creditor in an Actio Pauliana in light of declaration of a third party’s bankruptcy following an initiation by the creditor in an Actio Pauliana of enforcement proceedings against the debtor.
